Construction and Development
Our firm has a team of both front end and dispute resolution experts in construction and development law. We have acted on numerous developments and construction projects throughout the South Island.
We act for contractors, developers, design professionals and private owners on a range of matters including advising on construction contracts (including standard forms such as NZS 3910 and 3915) and opinion work in respect of general construction issues, the Construction Contracts Act 2002 and leaky building cases.
Our construction litigation experience includes extensive advocacy before the Courts, in arbitrations and in special tribunals including the Weathertight Homes Tribunal. We have represented clients in adjudications under the Construction Contracts Act 2002 and have acted in cases that have influenced New Zealand construction law; for example Bills v Arnold Jensen (2005) Limited (High Court, Christchurch CIV-2008-409-1349, 10/10/08, Fogarty J).
We provide advice on the following areas:
- construction contract documentation and administration;
- lease, design and build agreements;
- Construction Contracts Act obligations;
- engagement of sub contractors;
- dispute resolution;
- leaky building issues; and
- building and workmanship related claims.
